Many Florida homeowners believe that having a will means their home will pass smoothly to their family.

Unfortunately, under Fla. Stat. § 733.101, all wills must be admitted to probate in the county of the decedent’s residence.

To avoid further stress during an already difficult time, consider having a Florida Lady Bird Deed prepared.  Here, at The Law Offices of Carolina Nunez, P.A. -- our Orlando estate planning attorney, Carolina Nunez, Esq. is able to help.

HOW A LADY BIRD DEED CAN HELP

A Lady Bird Deed, also called an Enhanced Life Estate Deed, is a legal document recognized in Florida that allows you to:

  • Keep full control of your property during your lifetime.

  • Sell, refinance, or change beneficiaries at any time.

  • Ensure your home passes directly to your chosen heirs upon your death without probate.

If your goal is to keep your home out of court and ensure a direct transfer to your children or heirs, a Lady Bird Deed may be the best option.

  • Probate often takes 6–12 months or longer.

  • Costs range from 3% to 7% of the home’s value in attorney’s fees, filing fees, and executor costs.

  • Even a valid will cannot bypass probate.

WHY AN ATTORNEY THAT SPECIALIZES IN LADY BIRD DEEDS IS MORE RELIABLE THAN ONLINE SERVICES

When working with Florida estate planning Attorney Carolina Nunez, you get a personalized approach to your Lady Bird Deed preparation. Online services may employ tools such as AI or employ individuals that are just given a template to fill out a form on your behalf.

Generic online deed services can leave costly mistakes:

  • Failure to comply with Florida homestead law.

  • Title defects that make refinancing or selling difficult.

  • Improper recording that leads to probate anyway.

QUESTIONS ABOUT LADY BIRD DEEDS

Q: If I already have a will, do I still need a Lady Bird Deed?

  • Yes. Under Fla. Stat. § 733.103, a will must still go through probate. A Lady Bird Deed avoids probate entirely.

Q: Can a married couple use a Lady Bird Deed?

  • Yes. If both spouses sign, the home can pass directly to the children. However, Florida’s homestead law protects surviving spouses and minor children, so the deed must be drafted carefully.

Q: What if my beneficiary is under 18 or disabled?

  • A simple deed may not be enough. In those cases, a trust may be better to protect the child’s interest.

Q: Is this better than a trust?

  • For many families, yes. A Lady Bird Deed is less expensive and simpler than a trust if the home is your main asset.

Q: Can the deed be done online?

  • Yes. Florida law permits Remote Online Notarization (RON) and e-recording in most counties. You can complete the process from home.
